Enforcement Department Roles

The Nasinu Town Council’s Enforcement department is an important part of the NTC regulatory management and plays a significant role in helping to achieve our objectives.

The Council’s Enforcement Team through its powers which it uses to detect, enforce, restrain, and prevent conduct that is illegal and poses harm to public health.

In taking regulatory action, the Enforcement team is guided by the following principles:

  • acting decisively
  • procedural fairness and integrity
  • proportionality

Not all enforcement investigations lead to legal action, however where the Council find that there have been illegal activities contrary to our regulating laws, the Council has a range of sanctions available. These include prohibition orders, demolition orders, powers to impose fines and penalties through court action. These sanctions allow the Council to deliver a safe and healthy community to our ratepayers.

RESPONSIBILITIES

  1. Enforcement

The Enforcement Team are employed to deal with any issues that affect Public Health such as, litter, accumulations of waste and obstruction. The Enforcement team facilitates in serving Notices, Summons and legal documents to offenders follow up with prosecution if required. Although regular patrols are carried out, the Council also relies on our Nasinu residents so our team is directed where there are persistent problems.

  1. Traffic Management

The Council is closely working with Land Transport Authority to regulate traffic within the Nasinu vicinity. This is enabled through issuance of parking and traffic fines whereby all offenders who have been fined are directed to Land Transport Authority for all payment of traffic fines.

  1. Litter Management

Residents who place litter outside the Kitchen waste, Green and white goods schedule are issued with a Removal Notice whereby following non-compliance, the offender is served with a Litter Notice.

Litter fines enforced under the Litter Act 2008 as follows:

  1. Road Sellers Management

The Council stringently enforces against all illegal road-side vendors who operate illegally from a road-side. The Enforcement team with its’ powers to remove a road-side set up, ensures that there are no illegal road-side setup and working with its’ relevant stakeholders to remove any illegal road-side set-up.
